This Privacy Policy is intended to help you understand the types of information we may collect from you or that you may provide when you visit the Website or download, install, register with, access, or use the App, and describes our practices for collecting, using, maintaining, protecting and disclosing such information. In viewing and using the Website and/or the App, you understand that Instructrr may use certain information, including your Personally Identifiable Information (as defined below) subject to the terms of this Privacy Policy, and you consent to (i) the terms of this Privacy Policy and (ii) to the collection and use of Personally Identifiable Information and other information by Instructrr pursuant to the terms of this Privacy Policy.

The Website and the App Are Not Intended For Use By Individuals Under 18 Years of Age

Our Website and our App are not intended for anyone under eighteen (18) years of age. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not: (i) use or provide any information on the Website or the App or, on or through any of the features available on the Website or the App or (ii) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. Collection of Information

We may collect Personally Identifiable Information or other personal information from you so that we can: (i) provide you with access to specialized portions of the Website and the App (your “Instructrr Account”) and to maintain, and secure such account; (ii) store information about your preferences, allowing us to customize your Instructrr Account according to your individual interests; (iii) provide your information to our payment processor to process payments for services you purchase through the Website or App; (iv) notify you when App updates are available; (v) contact you to respond to inquiries related to the Website or the App; ; (vi) communicate with you to provide you with relevant information about Instructrr, including special promotions, discounts and newsletters; (vii) provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses; (viii) identify, investigate, and respond to, and prevent fraudulent or illegal activity (such as incidents of hacking or misuse of our websites and mobile applications), and claims and other liabilities; and (ix) enhance or repair the functionality of the Website or App or improve our services. We collect Personally Identifiable Information solely for the purposes of providing these services, but may collect other personal information or non-personal information in order to operate, maintain, and improve the Website and our services.

We will collect Personally Identifiable Information from you if you voluntarily submit such information to us through the Website and the App.


You have a choice as to whether to provide us with Personally Identifiable Information. When you purchase an item or service through the Website or App, your payment will be processed by Stripe. In processing such orders, Stripe will collect certain Personally Identifiable Information including: your name, telephone number, e-mail address, billing information (credit card number, expiration date and billing address), products purchased, any relevant promotion code and the recipient’s name, address and telephone number.

Information collected by Stripe will be used pursuant to the terms of the “Stripe Privacy Policy” found at: https://stripe.com/privacy. As described in the Stripe Privacy Policy, Instructrr may be provided with certain Personally Identifiable Information provided to Stripe by you, which will be used by Instructrr pursuant to the terms of this Privacy Policy. Instructrr is not responsible for the policies or activities of Stripe and we suggest that you contact Stripe directly if you have questions about the Stripe Privacy Policy.

We may process your information in the country where it was collected as well as other countries where laws regarding processing of information may be less stringent than the laws in your country.

Security of Information

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Personally Identifiable Information, we have put in place reasonable physical, electronic, and managerial procedures to safeguard and secure the Personally Identifiable Information we collect online, and we make good faith efforts to store your Personally Identifiable Information in a secure operating environment.

You must also seek to protect against unauthorized access to any Personally Identifiable Information or other personal information that you use in connection with the Website or the App, and you should remember to close the browser once you have completed your activities on the Website or the App or if you have decided to step away from your computer or mobile device. User Contributions

The Website and/or App may use “cookies” and/or other technologies or files (collectively, “cookies”) to identify how visitors make use of the Website and/or App. This aggregate tracking information may be used to help us improve and enhance the website and mobile application experience for all of our visitors. These third party websites have separate data collection and privacy practices independent from ours, and Instructrr is not responsible for the policies or activities of such other websites. Please contact such third parties directly if you have questions about their privacy policies.

Disposal of Personally Identifiable Information

To the extent that you have stored, submitted, transmitted, disclosed, or shared Personally Identifiable Information to or with us, Instructrr will take reasonable steps to dispose of or arrange for the disposal of your Personally Identifiable Information within its custody or control by shredding, erasing, or otherwise modifying your Personally Identifiable Information to make it unreadable or undecipherable by any means if: (a) Instructrr ceases operations or (b) you delete the App and cease all use of the Website, and provide written notice to support@instructrr.com

Retention of Personally Identifiable Information

To the extent permitted by applicable law, we retain Personally Identifiable Information that we obtain about you as long as it is needed for the purposes for which we obtained it, in accordance with the provisions of this Privacy Policy. If we have another lawful basis for retaining your Personally Identifiable Information, we may retain such information beyond the time period necessary to serve the original purpose for collecting such Personally Identifiable Information.

Data Transfers

We may transfer the Personally Identifiable Information and other personal information we obtain about you to the United States and other countries, other than the country in which the information originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. In compliance with the Privacy Shield Principles, Instructrr commits to resolve complaints about our collection or use of your Personally Identifiable Information. If we cannot resolve your complaint to your satisfaction, you may invoke binding arbitration, as described in Annex I to the Privacy Shield Principles.

Instructrr has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) and to Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved Privacy Shield complaints concerning data transferred from the EU and Switzerland. If you do not receive timely acknowledgement of your complaint from us, or if we have not addressed your complaint to your satisfaction, you can contact the European Union and/or Swiss DPAs for more information or to file a complaint. The services of the European Union and Swiss DPAs are provided at no cost to you.

If we make any substantive changes to our Privacy Policy in the future with regard to how we use your Personally Identifiable Information, we will incorporate those changes here. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (“CCPA”) (Cal. Civ. Deletion Request Rights

Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.



We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Some personal information we maintain about Consumers is not sufficiently associated with enough personal information about the Consumer for us to be able to verify that it is a particular Consumer’s personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, we do not include that personal information in response to consumer requests.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected Instructrr Account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We do not knowingly “sell” personal information that we collect from you, in accordance with the definition of “sell” in the CCPA, and will treat personal information we collect from you as subject to a do not sell request.

Response Timing and Format

We will make commercially reasonable efforts to identify Consumer personal information that we collect, process, store, disclose, and otherwise use and to respond to your California Consumer privacy rights requests.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

· Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
· Provide you a different level or quality of goods or services.
· Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

· To Comply With Applicable Laws or Performance of A Contract. In specific circumstances, we may need to process your Personally Identifiable Information to comply with a relevant law or regulation or to fulfill our obligations under a contract to which you are subject.
